Article 83 of the Costa Rican Labor Code states that an employee can terminate a labor relationship, with employer’s liability, if his or her employer does not comply with the prevention measures required to protect the health of its employees.
Among the measures recommended to mitigate the effects of an epidemic like Covid 19, is to implementation the mandatory compliance of the prevention measures recommended by the sanitary and health authorities. Likewise, establishing procedures to be followed upon detection of a contagion is very important. Internal policies punishing those who do not comply with these protocols is also necessary to make sure that such are effective.
